H-2B Lottery & Visa Cap 2026

The H-2B program has an annual numerical cap of 66,000 visas. When demand exceeds the cap, USCIS conducts a random lottery. Here's what employers and workers need to know for 2026.

How the H-2B Cap Works

Congress sets an annual limit of 66,000 H-2B visas per fiscal year — 33,000 for the first half (October–March) and 33,000 for the second half (April–September).

When USCIS receives more petitions than available visas on the first day petitions can be filed, they conduct a random computer-generated lottery to select which petitions will be processed.

Petitions not selected in the lottery are rejected and returned with filing fees. Employers who are not selected must wait for the next filing period or rely on supplemental visa allocations.

H-2B Supplemental Visa Allocations

In recent years, Congress and DHS have authorized supplemental H-2B visa allocations beyond the 66,000 cap to address labor shortages. These supplemental visas are typically available to returning workers — those who held H-2B status in one of the prior three fiscal years.

How to Maximize Your Chances

File Early

File your petition as close to the first available filing date as possible. USCIS conducts the lottery on the first day petitions can be submitted — timing matters.

Use a Returning Worker
